We carefully draft, review and negotiate the real estate contract and provide a complete and thorough explanation to our clients

In preparing for closing we diligently work to clear all title and any other pre–closing issues so that the closing
can be scheduled without unnecessary delay.
Our office explains all of the mortgage and loan documents to our clients and works closely with their lender to provide
all of the necessary legal documents required to schedule the closing.

Short Sales and Loan Modifications

detailed analysis along with a course of action that is best for our clients. Whether it´s a loan modification or short sale,
we zealously represent our clients until the matter is concluded.
A short sale is when a lender agrees to release their lien against the home for less than the outstanding mortgage balance so that
the home can be sold for its current value regardless of the outstanding mortgage amount.
The process to obtain short sale approval from the lender is what requires an experienced professional to negotiate on behalf of the homeowner.
At The Law Office of John A. Testaiuti, we have experience in successfully closing numerous short sales with
various lenders and financial institutions.
From the drafting of the special short sale contract of sale, to the ongoing negotiations with the lenders, we possess the necessary expertise,
knowledge and patience required for a successful short sale transaction.
We have obtained countless short sale approvals on behalf of our clients.
A loan modification is sought when we make a request to the lender to change the terms of our clients´ original mortgage/loan.
This can involve a change in the interest rate, change in the monthly payment and change to the original amount of years
required to pay back the loan.
In pursuing the loan modification for our clients, we fill out the application, gather all of the supporting documentation along with the
various affidavits and submit a completed application to the lender. From the point of submission to the lender, we continuously follow up with
the lender to provide any additional paperwork that they may require to reach their decision.
